After issueing a writ of execution to obtain the money still owed by the defendant... I was informed that the Sheriff did manage to seize it.... but - unfortunately & not unsurprisingly... the defendant filed a "claim of exemption" which means I as the plaintiff am required to go back to court to oppose that claim... so yep- heading back to court on 12-11-2023- but I'm not going - I submitted my reasons for the opposition including pointing out the defendant is lying about her finances as she obviously didn't include her rental income & she claimed she is paying the College expenses of Defendant # 2 who she claimed for the last year she has no clue where he is & she even demanded the court have me collect the Judgement from him....
Don't know what the Judge will decide- but If I were the judge- I would say- Claim of Exemption Denied- it would end the case- & I would be able to remove the Lien from her property... - If the Judge approves the defendants claim- then I'm looking at another 6 years on top of the 6 years I've already entailed- in the Court System.
I'm can only hope the Judge is tired of seeing us in the court room.
