Not surprised to learn John Matteson (friend of my next door neighbor Linda Crosnoe) filed an appeal on the small claims case after the Judge awarded me $2,500 for damages he intentionally did to my property... he is like the kid that ask Mom if he can go outside - and when Mom says NO- he goes to Dad... to get a different answer - of course I had selfishly hoped there would be no more court dates after 7 yrs of being victimized by my neighbor & her friends- but alas- since they get all their court stuff for free... they file every appeal, continuence, delay , postponement they can & I'm required to keep proving over & over to multiple Judges in multiple court rooms that my neighbor & her friends are not nice to me - I've said it before- & I will say again- the Justice System is punishing the victims for being victims... The "Appeal" (Trial De Novo) court date is set for 4-7-2025 at 8:30am in RM 43 in the Ventura Superior Court- I need to decide if I will go- If I do- that means I have to take another day off work... & once again prove I deserve to be compensated for all the intentional damages to my property- if I don't go- that means the Judge will automatically dismiss the case & the Judgment awarded to me is dismissed as well... Whew! it was a rough day in Court today- Court is NEVER fun- especially when you have to encounter a Commissioner/Judge who is clearly not willing to admit to their mistakes during the case they are overseeing. - Kelly Vs Crosnoe has entailed multiple Judges due to the multiple cases - all of them were willing to consider the facts- before making any decisions- Commissioner Julia Snyder has been overseeing the collection aspect of my cases against my nasty neighbor who has forced me to be in the Ventura County Court System for over 7 years - being required to prove her actions against me , my family & my property- I felt Justice was served when the Judges awarded me the Judgments based on FACTS.- I had no idea 7 years later Commissioner Snyder would REQUIRE me to pay the defendant all the money I gave to the courthouse in filing fees, sheriff fees & be told I was not "ENTITLED" to collect the Cost After Judgment (685.070) or the 10% Interest after 7 years (every other plaintiff is- just not me) - I should've just given all those court fees directly to the defendant since all her cost were always waived- Commissioner Snyder further falsely accused me of being deceptive RE: The Writ of Execution claiming I did a Bait & Switch when the fact is- the Clerks office made that mistake (Not Me) Commissioner Snyder Then accused me of intentionally omitting the $888.80 the Sheriff seized on 2-2-24- Which Crosnoe submitted on a court order on 2-9-2024 prior to the upcoming hearing but didn't file a claim of exemption- as required to cease the check being sent to me- After being told I'm a dishonest person by the Commissioner who flat out refused to acknowledge that NONE of the mistakes were made by me- ALL were made by HER & the Clerks Office -I made the mistake of blurting out it wasn't my responsibility to cancel that writ of execution- as she never notified me or the clerks or the sheriff to terminate that writ- it was the Commissioners duty to do so- I also pointed out I've never worked so hard for $1,500.00 in my life... over 30 Required court apperances & over $1,200.00 in court fees...- Commissioner Snyder then proceeded to throw me under the bus telling me she would charge me with contempt of court if I "say another word"- with that I opened my purse - grabbed the envelope with the check stub and the cash from the bank- & threw the money at Crosnoe - & walked out. I do not know WHY Commissioner Snyder has treated me as if I'm the criminal... for trying to collect the money awarded due to the criminal... but after 7 years I really did not antcipate the Kelly Vs. Crosnoe Civil Case to end with me becoming the "bad guy" & the Judgment debtor. I anticipate Karma isn't gonna just be knocking on Crosnoes door.... Commissioner Julia Snyder refused to acknowledge HER mistakes in that courtroom & could've reversed those miskes by terminating the order I pay the defendant the money I had to pay the courthouse- she ignored the law completely CCP 473 Rule 60 Motion B (1) & held me liable for HER mistakes. So the defendant is doing a happy dance for now since she got rewarded for being a defendant - (she made money off of destroying my property & telling a bunch of lies) & Commissioner Snyder can pretend I deserved to be held liable for HER mistakes in HER courtroom.... but it doesn't change the FACTS. Miss Ruby Tuesday- Kelly Vs Crosnoe- Prepping For 7-16- 24 RO Court Hearing

Lots of Chaos still happening next door and the closer it gets to the court date the usual antics are taking place- its clear my next door neighbor (Crosnoe) & her friends are not done causing me grief- they keep pushing boundries & flat out violating the TRO- in hopes of getting me to respond- & are "lying in wait" ... The Restraining Order Hearing against my neighbor is scheduled for Tuesday 7-16-2024 at the Ventura County Superior Court at 2pm in RM 34- Hopefully there will be no more postponements, delays or sudden illnesses. There have been 3 postponements so far.... & my neighbors attorney is now trying to get me to consider "Dissolving the request for the RO against my neighbor &/or agree to another postponement...." Its been 7 years of my having to fend off the actions of my neighbor- 7 years of replacing property damaged by my neighbor & her friends. 7 years of court dates due to having to sue for the damages. 7 years of being required to save "Proof" for the court. 7 years of my being required to save all paperwork. 7 years of prepping for this hearing.... I currently have a TRO- (temporary restraining order) & its been helpful keeping my neighbor from further destroying my property- but then she filed ANOTHER false restraining order against me right after I removed the lien on her house from the last false Elder Abuse Case she filed against me- & now - she wants me to 'make a deal to avoid litigation" Translation: She doesn't want to be put on the witness stand & she doesn't want the Judge to see the videos or see the police reports. I want the hearing to take place- even if the Judge does not grant me the permanent order - I want the opportunity to show the Judge what I've been contending with & have it on record. I want to hold my neighbor accountable- I deserve to get some answers as to WHY my neighbor & her friends all feel they need to harrass me & destroy my fences, my cameras, my lighting -I'm not related to Crosnoe, I'm not in a relationship with her, I do not rent a room from her- I'm just her neighbor & I've never done anything to her. I'm not required to know her - much less deal with her on a daily basis in a negative manner - to the degree it affects my home life, my work life & my finances. Yes- I have my list of Questions ready to go for the moment I put her on the witness stand... Have you ever heard the term "Look for the loophole"??? - Well- when it comes to Court cases sometimes you need to look for a "Legal Loophole" I tried to end the settlement agreement with my crazy neighbor- by proving Breach of Contract - unfortunately- the Commissioner refused to end it & told the defendant she only needed to make up the last 5 payments... I then put in a request for reasons of the decision NOT to end the contract after proof of Breach of Contract- & the commissioner denied me the right to know the reason... I then put in another request - once again it was "Denied". - my crazy neighbor then put in a request demanding the Court force me to remove the lien on her property 2 days after she destroyed my front yard fence... fortunately that was "Denied" as I obtained that lien legally- I contacted my lawyer & he explained to me that I needed to look for a legal loophole as there was no reason for me (the Plaintiff & Judgement Creditor) to have to prove I deserve a right to collect my Judgement- ... so- did some research & yes- there was/is a Legal Loophole! - & in my case... it is called the "Joint/Several Defendant Rule" :-D #KellyVsCrosnoe #neighborfromhell missrubytuesday.com

The daily non stop daily attack from the Crosnoe Circus Clowns & the inability to convince Commissioner Snyder to end that settlement agreement after proving Breach Of Contract -then learning the Court Order and Answer I submitted under CCP632 (Statement of Decisions- Request For Reasons) was also denied-- is really starting to affect my daily life!- I am being bombarded with paperwork and timelines again!- Dang- I was done with court 3 yrs ago - it was 3 yrs of court dates & I prevailed in all 3 cases- & I mistakingly ALLOWED the main Defendant (Linda Crosnoe) to make monthly payments with the understanding that if she missed her payments I could end that contract- she missed her payments & I asked the court to end the settlement agreement- thats what gave the defendant the green light to bring me back into the court system- she demanded a hearing stating "she had proof all payments were made" (which of course she did not) & after I proved they had not- The Commissioner insisted I keep financing her & told her she only had to make up the last 5 payments missed!- The commissioner threw me out of the court room when I stated I wanted that contract ended- & there is no law that requires me to communicate with the defendant- a week later- I obtained the audio from that hearing- & it clearly reveals I proved Breach Of Contract & I (the Plaintiff seeking Justice) was thrown out of that courtroom- upon that denial I have now been sucked into the court system again... in another battle to PROVE I deserve to collect the money that was awarded to me by 3 other Judges!!!!- I now am required to submit one more Court Order And Answer- before I can file a complaint to the Judiciary Committee- The ordeal I'm currently encountering almost makes me forget I'm the Plaintiff- The Judgement Creditor! I cannot stress enough- If you are a plaintiff in a civil case- do NOT let the Judge or the Court Mediators convince you to enter into a settlement agreement with the defendant- the court will not honor its own contract it convinced you to enter into... even when you can prove Breach Of Contract- & more importantly- if you challenge/question that decision - it will just anger the Judge/Commissioner- I got thrown out of the court room when i asked WHY the commissioner would not end the settlement agreement.... I then put in a request via 'Court Order And Answer" for "reasons statement"- & requested a motion for reconsideration- upon learning of my request- the Defendant put in a false declaration claiming I assaulted her & she demanded a hearing asking that the other 2 defendants pay the balance- - well.... its no surprise the commissioner denied me my request for reasons pertaining to not ending that settlement agreement- as well as that motion for reconsideration- but on the bright side- the commissioner also denied the defendant a hearing based on the submitted declaration. - I now need to submit another "request for court order" seeking reasons for decision- if that is also denied- then I will need to submit a complaint to the judicary committee. - seriously DO NOT ENTER INTO ANY CONTRACT WITH THE DEFENDANT- its now been 6 yrs that I've been forced to deal with the defendant.- its like I'm being punished for being the victim of the defendants actions... fortunately there is NO LAW that states I am REQUIRED to communicate with the Defendant.- #KellyVsCrosnoe #BreachOfContract #neighborfromhell http://www.missrubytuesday.com http://www.akamissrubytuesday.blogspot.com
